What is the claim making process?
After your comparison and services/deals selection, you will be contact by your chosen solicitor as soon as possible. During business hours you will receive a reply to your enquiry or claim as soon as possible. Unfortunately during the weekends and national holidays the offices are closed and therefore your chosen firm will contact you when the offices re-open. Your personal injury solicitor will then guide you through every step of the claim, ensuring that you are kept informed as your claim progresses.
How much can I claim?
To determine what an individual can claim is not an easy task. The case has to be thoroughly examined and a medical has to be carried out before any assumption to as what you might receive in compensation is derived. Compensation claims generally follow a ‘tariff’ whereby similar claims are entitled to similar amounts. You can use our claim calculator as guidance to show you the compensation amounts.
In addition to these amounts, it may be necessary to claim special damages which pertain to the loss of earnings due to the other party’s negligence. Special Damages can be fixed to some extent and are awarded as a result of you encountering ‘special losses’ due to the accident. In particular, Special damages are payable on any loss of earnings, including any potential loss of future earnings, as a result of the accident you may have to endure while you recover from the accident. Car hire expenses that you have to pay as a result of your car not being road worthy or the repair costs; if you have to pay someone to look after you while you recover from your injury can be claimed; and if you have paid for medical attention or treatment for the injury can also be included. Please advise your personal injury solicitor of all the damages you wish to seek.
Does No Win No Fee help me?
This system can help those who may have been prevented from claiming due to lack of money. A case that is considered to have a reasonable chance of success can now be taken on by a personal injury solicitor regardless of the financial means of the claimant. This has made the system fairer and easier to deal with.
Would I need to fill in a lot of paperwork?
Not much as we know that a lot of paperwork can be intimidating, so your personal injury solicitor will talk you through the process and will deal with most of the paperwork for you.
Will I need to go court?
That depends on if your claim is disputed. Many claims are settled outside of court, with the parties reaching agreement between themselves. In some instance, the defendant refuses to accept liability and the case needs to be heard in court. Your solicitor will always be on hand to guide you through the process.
Who pays my compensation?
Your compensation is paid by the losing party. If liability has been accepted outside of court, the defendants will make an offer of compensation. Your personal injury solicitor, who is very experienced in these matters, can advise you whether or not to accept or to wait for a higher offer. If the case has gone to court, a successful outcome will result in the judge making an award, which the losing party will have to pay. How long would it take?
This depends on the nature of the claim and whether or not it is disputed. A claim that is accepted by the other side will be dealt with much quicker than a disputed case that goes to court. In either case, your solicitor will be able to advise you as to the likely time scale and will keep you informed along every step of the way.
